Terms of Service

These Terms of Service ("Terms") govern your use of MarketTheListing ("the Service"), an AI-crafted, expert-reviewed real estate listing marketing service. By creating an account, you agree to these Terms.

1. The Service

For each listing you submit, MarketTheListing produces one marketing package — a social graphic, a listing flyer, and an email graphic — generated by AI from the property details and photos you provide, and reviewed by a person before delivery. Packages are billed in credits, drawn from your plan's monthly credit pool or a top-up purchase. Delivery is within 1 business day of a complete, credited submission.

2. Accounts

  • You must be at least 18 years old and able to enter a binding contract.
  • You must provide accurate information and keep your login credentials secure.
  • You are responsible for activity that occurs under your account, including team members you invite.
  • You must hold any licenses required to market and list the properties you submit.

3. Plans, credits, payment, and refunds

  • New accounts receive a one-time trial credit grant, enough for one marketing package, after email confirmation — no card required.
  • Paid plans bill monthly through PayPal and include a stated monthly credit allowance; unused credits do not roll over. You may purchase additional top-up credit packs at any time.
  • Subscriptions renew automatically each month at the then-current price until you cancel. You can cancel at any time from the Billing page or your PayPal account — cancellation takes effect at the end of the paid period, after which the account returns to the Trial plan.
  • If we fail to deliver a submitted package, your remedy is, at our option, re-delivery of the package or a refund of the credits or amount paid for it. Delivered work is otherwise non-refundable, but we will make reasonable revisions per our revision policy.

4. Your content and your review

You retain ownership of the photos and information you upload. You grant us the right to use that content solely to produce your marketing materials and operate the Service. You represent that you own or are licensed to use all content you upload. Finished deliverables are yours to use without restriction once delivered.

You are the publisher of your marketing. You must review every deliverable for accuracy (including prices, addresses, and property details) and for compliance with the Fair Housing Act and your licensing rules before publishing it. We are not responsible for errors or legal issues in materials after you approve, download, or publish them; if you spot a problem first, request a revision and do not publish.

5. Acceptable use

You may not use the Service for unlawful purposes, submit listings you are not authorized to market, upload malicious files, or attempt to disrupt or gain unauthorized access to the Service.

6. Disclaimers and liability

The Service is provided "as is." We do not guarantee specific marketing outcomes, sale results, or uninterrupted availability. To the maximum extent permitted by law: (a) we are not liable for indirect, incidental, special, or consequential damages of any kind — including lost commissions, lost profits, lost deals, or lost business opportunities — even if advised of the possibility; and (b) our total liability for all claims combined is limited to the amounts you paid us in the three months before the claim arose.

7. Indemnification

You will defend and hold us harmless from claims, damages, and reasonable legal costs arising from content you upload, listings you submit, marketing you publish, your violation of these Terms, or your violation of any law — except to the extent caused by our own misconduct.

8. Termination

You may close your account at any time. We may suspend or terminate accounts that violate these Terms. Upon termination you may request a copy of your delivered materials within 30 days.

9. Changes

We may update these Terms; material changes will be announced in the app or by email. Continued use after changes take effect constitutes acceptance.

10. Disputes, governing law & boilerplate

These Terms are governed by the laws of the State of Michigan, USA. Any dispute will be resolved by binding arbitration in Michigan on an individual basis — both sides waive class actions and jury trials — except that either side may use small-claims court for qualifying claims. Claims must be brought within one year of arising. If any provision is found unenforceable, the rest remain in effect. These Terms are the entire agreement between us regarding the Service.
